Server

Also called waiter/waitress, these positions are responsible for taking orders from customers, explaining daily specials, placing orders in the kitchen, and serving food to customers. The second step is for the employer to initiate the PERM labor certification process. This includes defining position descriptions, filing prevailing wage requests, recruiting for positions, and filing PERM labor certification petitions.


The third step is the I-140 petition. It is filed with USCIS. The I-140 filing includes proof of the employer's ability to pay the proposed salary and the potential employee's qualifications for the minimum requirements of the position. I-140 can be filed only if PERM labor certification is approved/certified.


The fourth and final step in the process depends on whether the beneficiary (potential employee) is legally inside or outside the United States.


Examples of being in the United States lawfully include F-1 or F-2 status, H-1B or H-4 status, -1 or L-2 status, etc.

For those who are legally in the United States, the process is called adjustment of status. This involves filing USCIS Forms I-485, I-765, I-131, and possibly I-485 Supplement J with USCIS. Processing time from filing to approval of the I-485 green card is approximately 8 months.

For people outside the United States, the process is called consular processing. This involves filing the DS-260 with the NVC on the CEAC website. After the DS-260 online filing, the US Embassy in your home country will schedule you for a visa green card appointment. After a successful interview, you will be issued an approval stamp on your passport. You will then travel to the United States as a permanent resident ready to begin working for your sponsoring employer. Your original green card/permanent residence card will be mailed to the address you previously provided on the DS-260 filing in the United States. Your green card/permanent residence card will be valid for 10 years.
